Filetico Terms of Use

These Terms of Use ("Terms") govern access to and use of the Filetico platform, including the website (filetico.com), the Android and iOS mobile applications, and the macOS desktop application (collectively, the "Service"), operated by Héctor [LAST NAMES], a sole proprietor ("persona física con actividad empresarial") under Mexican law, with registered address at Av. Patria 2085 - 105, Puerta de Hierro, 45116 Zapopan, Jalisco, Mexico ("Filetico," "we," "us," or the "Operator").

By creating an account, downloading, installing, or otherwise using the Service, you ("User") agree to be bound by these Terms and by our Privacy Notice. If you do not agree, do not use the Service.

1. Description of the Service

Filetico is a cloud file storage, synchronization, and management platform, available via web browser and native applications for Android, iOS, and macOS. Files uploaded by Users are physically stored using third-party infrastructure, specifically Cloudflare R2 object storage (see Section 8).

2. Eligibility and Account Registration

• You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account and purchase paid plans. Minors may only use the Service under the supervision and consent of a parent or legal guardian, who assumes responsibility for such use.
• You are responsible for providing accurate information when registering and for keeping your login credentials confidential. Registration may be completed via email and password, or through third-party authentication providers (e.g., Google, via Firebase Authentication infrastructure).
• You are responsible for all activity that occurs under your account. Notify hola@filetico.com immediately of any unauthorized use.

3. Service Plans and Payments

• Filetico offers a free plan with limited storage and functionality, and paid plans ("Premium" or equivalent) offering additional capacity or features.
• Payments for paid subscriptions are processed by third-party payment processors (Stripe and/or PayPal). Filetico does not store your full payment card details; that information is handled directly by the payment processor under its own policies.
• Paid subscriptions renew automatically at the end of each billing cycle unless cancelled beforehand by the User from their account dashboard.
• Except as required by applicable law, payments are non-refundable. Exceptions will be evaluated on a case-by-case basis upon request to hola@filetico.com.
• We reserve the right to change plan pricing, notifying affected Users at least 15 calendar days before the change takes effect on their next renewal.

4. License to Use

Subject to your compliance with these Terms, Filetico grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Service's applications solely for your authorized personal or internal use. You may not decompile, reverse-engineer, resell, sublicense, or commercially exploit the software without prior written authorization.

5. User Content

You retain all ownership rights in the files and content you upload to the Service ("User Content"). By uploading User Content, you grant Filetico a limited, non-exclusive license to host, copy, transmit, and display such content solely to the extent necessary to operate, maintain, and provide the Service (for example, to enable cross-device synchronization or generate previews).

You represent and warrant that you hold all rights necessary in the User Content you upload, and that such content does not infringe any third party's rights or violate applicable law.

6. Prohibited Conduct and Content

You may not use Filetico to upload, store, transmit, distribute, or link to any of the following, or to engage in any of the following activities:

• Child sexual abuse material (CSAM) or any content that sexualizes minors, under a zero-tolerance policy. Filetico will immediately report such content to the relevant authorities (including, where applicable, NCMEC and Mexican authorities).
• Pornography or sexually explicit content of any kind.
• Content that is unlawful under the laws of Mexico, the United States, the European Union, or your jurisdiction, including but not limited to: material that infringes third-party copyrights, trademarks, or patents; content that promotes or incites violence, terrorism, discrimination, or hatred; defamatory material; and content related to drug, weapons, or human trafficking.
• Malware, viruses, ransomware, or any code designed to damage the Operator's or third parties' systems.
• Fraud, identity theft, phishing, or unauthorized collection of other users' data.
• Attempts to breach, overload, or interfere with the Service's infrastructure, security, or availability (including denial-of-service attacks or unauthorized vulnerability scanning).
• Using the Service to send spam or unsolicited bulk communications.
• Unauthorized resale, sublicensing, or commercial exploitation of the Service or its storage capacity.

Filetico reserves the right, but not the obligation, to review stored content when there is a complaint, court order, or reasonable indication of a violation of these Terms, while otherwise respecting the confidentiality of your remaining User Content.

7. Suspension and Account Termination

• Filetico may suspend or terminate, immediately and without prior notice, the access of any User who violates these Terms, particularly Section 6 (Prohibited Conduct and Content).
• If your account is terminated for a violation, you will not be entitled to a refund of prior payments, and Filetico may delete your stored User Content, unless retention is required by law or a competent authority.
• You may cancel your account at any time from your account settings. Following cancellation, your files will be permanently deleted from our storage infrastructure within the timeframes described in the Privacy Notice.
• We may also suspend the Service, in whole or in part, for maintenance, force majeure, or a decision to discontinue the product, notifying Users in advance when reasonably possible.

8. Third-Party Data Storage

Files you upload to Filetico are physically stored using Cloudflare R2 object storage, operated by Cloudflare, Inc. Cloudflare acts as a data processor for the technical storage of your files; Filetico remains responsible to you for the management and protection of that information under these Terms and the Privacy Notice. Cloudflare operates data centers globally, so your files may be stored or processed on servers located outside of Mexico.

9. Filetico's Intellectual Property

The "Filetico" name, logo, interface, source code, and other elements of the Service are the property of Filetico or its licensors and are protected by intellectual property laws. These Terms do not grant you any rights in such trademarks or elements, other than the license described in Section 4.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available." Filetico does not warrant that the Service will be uninterrupted, error-free, or completely secure. You are encouraged to maintain independent backups of your User Content. To the maximum extent permitted by applicable law, Filetico disclaims implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Filetico will not be liable for any indirect, incidental, special, consequential damages, or loss of data arising from the use or inability to use the Service. Filetico's total liability to you under any circumstance will not exceed the amount you paid for the Service during the six (6) months preceding the event giving rise to the claim.

12. Indemnification

You agree to indemnify and hold harmless Filetico, its operators, and collaborators from any claim, damage, or expense (including reasonable legal fees) arising from: (a) your User Content; (b) your breach of these Terms; or (c) your violation of any third party's rights.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated through the Service or by email at least 15 days before they take effect. Continued use of the Service after the effective date constitutes your acceptance of the updated Terms.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of the United Mexican States. Any dispute relating to these Terms shall be submitted to the competent courts of Zapopan, Jalisco, Mexico, and the parties waive any other jurisdiction that might correspond to them by reason of their present or future domicile.

15. General Provisions

• If any provision of these Terms is held invalid, the remaining provisions will remain in full force and effect.
• Filetico's failure to enforce a right does not constitute a waiver of that right.
• These Terms, together with the Privacy Notice, constitute the entire agreement between you and Filetico regarding the Service.
